These Terms govern your use of Spicoli Surf Guide (“Spicoli” or the “App”), operated by 433 LLC (“we,” “us,” or “our”). By creating an account or using the App, you agree to these Terms.
Spicoli provides AI-generated surf information, forecasts, spot descriptions, and recommendations based on public ocean and weather data. We may change, suspend, or discontinue features and may impose reasonable usage limits to keep the service available.
You assume responsibility for deciding whether and where to enter the water. Never rely solely on the App. AI responses and source data may be incomplete, delayed, or wrong.
You must provide accurate information, protect your credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity on your account. You may not create an account if prohibited by law.
We may suspend or terminate access for violations, security risk, abuse, or nonpayment if paid features are introduced.
AI-generated content is provided “as is” and may contain errors. Forecasts depend on third-party data and models that we do not control. Verify important information with official and firsthand sources.
Spicoli’s software, design, and original content belong to 433 LLC or its licensors. NOAA and other third-party information remains subject to its source terms and attribution. These Terms give you a limited, revocable, non-transferable right to use the App for personal purposes.
You retain rights in prompts or other content you submit. You give us a limited license to process that content solely to provide, secure, support, and improve the service as described in the Privacy Policy.
You may delete your account from the Profile screen. Deletion is irreversible and handled as described in our Privacy Policy.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ACCURACY, AVAILABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 433 LLC AND ITS MEMBERS, CONTRACTORS, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR INJURY, DEATH, PROPERTY DAMAGE, LOST DATA, LOST PROFITS, OR LOSSES ARISING FROM OCEAN ACTIVITY OR RELIANCE ON THE APP. WHERE LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE PRECEDING 12 MONTHS.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where consumer law in your location requires otherwise.
We may update these Terms. We will provide notice of material changes when required. Continued use after the effective date means you accept the revised Terms.
Spicoli Surf Guide's optional SMS program is operated by 433 LLC. It provides recurring automated surf-condition alerts based on your usual surf region and interests. Surf alerts are included with Spicoli Pro and the free app trial. Conversational replies to surf questions by SMS are not available in this release.
To opt in, sign in to Spicoli with a verified U.S. phone number, open Profile → Manage SMS opt-in, review the SMS disclosure and AI data-processing notice, select the unchecked agreement box, and choose Turn on surf alerts. Consent is not required to create an account or buy a subscription and is not a condition of purchase. A subscription or phone-verification code does not enroll you in product SMS.
Message frequency varies based on your surf region and matching conditions. Message and data rates may apply. Your carrier's charges are separate from any Spicoli subscription. Delivery depends on service availability and carrier support and may be delayed or fail. Carriers are not liable for delayed or undelivered messages. SMS is not an emergency, lifeguard, or ocean-safety service.
You can withdraw SMS consent in the App, or reply STOP to opt out; you may receive a confirmation of your withdrawal. Reply HELP for assistance or email [email protected]. START or UNSTOP can remove a carrier-level messaging block, but does not enroll an unknown phone number or replace the required in-app consent.
Keep your account phone number current. A change to the verified number revokes the previous SMS opt-in; you must review and opt in again for the new number. Our Privacy Policy explains how phone numbers, consent records, SMS content, and service-provider processing are handled.
Spicoli Pro is offered as monthly and annual auto-renewing subscriptions through Apple's in-app purchase system. The App displays the price, billing period, and included features before purchase. Payment and renewal are handled by Apple. You can manage or cancel a subscription in your Apple Account settings. A limited free app trial is separate from a subscription purchase and does not automatically enroll you in a paid subscription. Deleting your Spicoli account does not cancel your Apple subscription. Audio features and other services have usage limits to protect availability and prevent abuse.
